Terms of Use

1. Purpose

These Terms of Use govern access to and use of the sandwicsh service, available at sandwicsh.com, and the associated Discord bot. By using the service, you unconditionally accept these Terms.

2. Access to the service

Access to the service requires a valid Discord account. Authentication is performed exclusively via Discord's OAuth2 protocol. No password is created or stored by sandwicsh.

Access to the service is subject to a usage quota depending on your plan. sandwicsh reserves the right to modify or discontinue the service at any time, particularly during the beta phase.

3. User responsibility

Use of the sandwicsh bot is the full responsibility of the user who activates it. By triggering a recording session via the commands /start_voicecoms or /start_debrief, the user acknowledges and agrees to the following:

  • They are solely responsible for informing all participants present in the voice channel that a recording session is in progress, in accordance with applicable laws on privacy protection and consent to recording.
  • They guarantee having obtained the explicit consent of all participants before starting a recording.
  • They agree not to use the service for unlawful, fraudulent purposes or in a way that infringes the rights of third parties.

sandwicsh disclaims all liability for use that does not comply with these Terms or applicable laws, particularly regarding recording without the knowledge of third parties.

4. Audio data processing

What we do with your audio data:

  • Audio data captured during a session is transmitted to the OpenAI API (Whisper) for automatic transcription.
  • Audio files are not retained by sandwicsh. They are sent to OpenAI and then deleted from our servers immediately after the transcript is retrieved (or if transcription fails).
  • The resulting text transcript is then analyzed by OpenAI's GPT-4o model to produce the result displayed in your dashboard.
  • The transcript and analysis result are stored in your personal space on sandwicsh.com and can be deleted at any time from your dashboard.

By using the service, you also agree to OpenAI's terms of use.

5. Personal data & GDPR

The only personal data collected is that obtained through Discord authentication: Discord identifier (snowflake), username and public avatar.

This data is used solely to identify your account and display your profile on the dashboard. It is never sold or shared with third parties, except for the audio data processing described in Article 4.

In accordance with the GDPR, you have the right to access, rectify, delete and port your data. To exercise these rights, contact us at contact@sandwicsh.com.

6. Cookies

sandwicsh uses only a functional session cookie, strictly necessary to maintain your login session. No advertising, analytics or third-party tracking cookies are used.

7. Service availability

sandwicsh is currently in beta. The service is provided "as is", without guarantee of continuous availability. Interruptions may occur for maintenance or service improvements. sandwicsh shall not be held liable for any temporary unavailability.

8. Amendments

sandwicsh reserves the right to modify these Terms at any time. Users will be informed of significant changes. Continued use of the service after modification constitutes acceptance of the new Terms.

9. Applicable law

These Terms are governed by French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of French courts.
